THJ & Associates successfully defends clinical negligence claim on behalf of ARGC and its Medical Director Mr Mohamed Taranissi

On 12 November 2025, following an 8-day clinical negligence preliminary issue trial on liability at the Central London County Court, HHJ Luke Ashby handed down judgment dismissing the claim against ARGC and its medical director Mr Mohamed Taranissi.

The claim itself was brought by the claimant in regards to the fertility advice and treatment she received at ARGC and subsequent stroke she suffered 10 days after being treated with IVF and intravenous immunoglobulin (IVIg). Following on from her treatment and stroke, and after further investigations, it was later discovered that the patient had an undiagnosed heart condition, which of itself can increase the risk of stroke.

The Claimant commenced proceedings in which she asserted that she had not given informed consent to IVF and/or IVIg treatment because (i) the advice she had been given about her prospects of success was negligent, and (ii) she had not been warned about what she alleged to be an increased risk of thrombosis from IVIg, as distinct from the risk of thrombosis from IVF, nor had she been advised about the controversies surrounding the use of IVIg in fertility treatment.

The Assisted Reproduction and Gynaecology Centre (ARGC) and Mr Mohamed Taranissi vehemently denied the allegations and defended the proceedings in full.

On the afternoon of Wednesday 12 November 2025, over four years after the claim was first issued, the Court dismissed the Claimant’s claim based on the following findings:

  1. In April 2018, a responsible body of medical opinion would have offered IVIg treatment;
  2. The Claimant’s prospects of success were not as low as she argued and that, on factual causation, the Claimant would have consented to IVF and IVIg treatment in any event;
  3. Further, there was no requirement for ARGC to advise on any additional risk of thrombosis in relation to IVIg specifically (as opposed to IVF) as there were no reported cases of thrombosis arising out of IVIg therapy in the context of fertility treatment; and
  4. In respect of medical causation, the Court accepted the Defendants’ Expert medical evidence, in that it could not be demonstrated on the balance of probabilities that the IVIg treatment had made any material contribution to her stroke.
